Child Support
UIFSA (The Uniform Inter-State Family and Support Act) permits the custodial parent in one state access to the legal system in another state where the non-custodial parent lives to establish and/or enforce a child support order. The non-custodial parent may also use UIFSA to initiate a case if he or she would like a court order for child support payments. The DeKalb County District Attorney is one of only 9 District Attorneys who have chosen to maintain child support prosecution divisions for the benefit of local county residents.

The DeKalb County District Attorney UIFSA office handles approximately 10,000 cases. The UIFSA office receives an average of 200-300 new case requests per month. These requests are received from out of state parents seeking support from a DeKalb County resident parent and from DeKalb custodial parents seeking support from an absent parent in another state.

The UIFSA office collected $13 million dollars in child support in 2003. The office continues to increase annual child support payments through enforcement actions including, Driver's License suspension, Income Tax intercept, Bank Match, Lottery intercept, Contempt actions, Negotiations with delinquent parents, etc..

The fee for this service is a minimal one-time $25.00 fee for processing. There is a newly instituted $100.00 fee for modification. These fees apply only to non-welfare cases. Anyone receiving welfare benefits or underemployed with a monthly income of $1,000.00 or less is exempt from paying the fees. The UIFSA petition must be completed to initiate an action in another state. If the custodial parent has no order, the completed petition along with the certified copy of the child's birth certificate and copy of the child's social security card are required. If the custodial parent has an existing order for child support, the completed petition along with a certified copy of the order are required to process the UIFSA action. Orientation for new clients is held each Wednesday at 9:30 a.m., appointments are necessary.
