The Grand Jury hears evidence presented by witnesses regarding felony charges. The charges are drawn on a document called an indictment. If after hearing from a witness, the Grand Jury is convinced there is sufficient evidence that a crime has been committed to warrant a trial before a trial jury, it is their duty to indict or present the accused. Felonies such as rape, murder and armed robbery are always presented to the Grand Jury. However, some felonies may be charged by accusation instead of indictment.
The following felonies may be charged by accusation, (1) if and only if, they were bound over by magistrate court to Superior Court, or the defendant expressly waived his preliminary hearing, or the defendant failed to show up at the preliminary hearing and the case was bound over, or the defendant was out on bond, and (2) if and only if, they are not accompanied by other felony charges not listed herein
(a) all theft by taking and theft by shoplifting cases occurring after July 1, 1992, and all other cases occurring after March 27, 1988
(b) entering an automobile
(c) deposit account fraud occurring after July 1, 1992
(d) all forgery, financial transaction card theft, and financial transaction card fraud cases occurring after July 1, 1992
(e) all other Title 16, Chapter 9 offenses, occurring after March 27, 1998
(f) possession of a firearm by a convicted felon or first offender probationer
(g) escape, occurring after July 1, 1992
(h) habitual violator (offenses occurring July 1, 1992 or after)
(i) the most common Violation of the Georgia Controlled Substances Act offenses, to wit possession, possession with intent to distribute, and sale of a controlled substance, marijuana or counterfeit substance. (Note trafficking cases must be indicted.)
The qualifications necessary for a person to be a grand juror are
(1) Citizen of Georgia; and also a citizen of the United States;
(2) Eighteen years of age or older;
(3) Resident of county for at least six months;
(4) Experienced, upright and intelligent.
